High Court’s decision on UP Panchayat elections, reservation will be based on 2015

Lucknow. The Lucknow bench of the High Court has given its verdict on the reservation system for seats in the UP Panchayat elections. The High Court said that considering the year 2015 as the original year, reservation should be implemented on the seats. Earlier, the state government itself said that it is ready to implement the reservation system, considering the year 2015 as the original year. On this, a division bench of Justice Rituraj Awasthi and Justice Manish Mathur has passed the order to hold the three-tier panchayat elections till May 25.




Let us tell you that the order of 11 February 2021 was challenged in the Lucknow Bench of the High Court. The petition states that under Rule 4 of the Rules relating to the implementation of reservation in Panchayat elections, reservation is applied to the seats of Zilla Panchayat, Setra Panchayat and Gram Panchayat. It was said that the elections of 1995, 2000, 2005 and 2010 were held, considering the year 1995 as the original year in relation to the implementation of reservation.

The petition further stated that issuing a mandate on 16 September 2015, instead of the year 1995, the year 2015 was considered to be the original year and the reservation should be implemented. In the said mandate itself, it has been said that according to the census of 2001 and 2011, a large amount of demographic change has taken place, so it will not be appropriate to apply the reservation as the original year of 1995. It was said that the mandate of 11 February 2021 was implemented, ignoring the said mandate of 16 September 2015. In which the year 1995 has been considered as the original year. It was also said that the Panchayat elections of the year 2015 were also conducted as per the mandate of 16 September 2015.
