New Labour Codes: COVID-19 changed the way work is done worldwide. The biggest change was the ability for employees to work from home. This was called work from home (WFH). After the COVID-19 pandemic ended, employees returned to working in the office. However, work from home continues in many sectors. It has many benefits, such as reduced operational costs. For this reason, the new labor codes also include rules regarding WFH.

Recognition of Work from Home

The new labor codes state that work from home is permitted in the service sector. This requires an agreement between the employee and the employer. Women on maternity leave can also work from home. The recognition of work from home in the new labor codes will alleviate the fear of job loss among employees practicing WFH.

Overtime Limits Eliminated

The new labor laws also address the issue of overtime. According to this, if employees work more than the prescribed number of hours, employers must pay overtime compensation. The overtime rate will be double the normal wage. The previously imposed overtime limit of 75 hours per quarter has been removed. State governments can set higher limits. Experts say that the new overtime rules will benefit employees who want extra income.

Free Medical Checkups for Employees

The government has made a significant decision in the new labor codes, which benefit employees. Employers will be required to provide free health checkups once a year to employees over 40 years of age. Employers will also be required to promote preventive care among employees. Currently, only a few companies offer this service to their employees. Now, all companies will be required to provide this service.

ESIC’s scope expanded

Now, ESIC coverage will no longer be limited to notified areas. It will be applicable nationwide. It will also apply to plantations, small enterprises, and units considered hazardous. Several decisions have been made in the new Labor Code to benefit gig workers. One important decision is that an accident occurring between home and workplace will be considered an employment-related accident. The employee will then be entitled to compensation.
