Passport Renewed: Children’s passports will be renewed without father’s consent, Gujarat HC issues major order

Passport Renewed: In Gujarat, the passports of two minors will be renewed even if they lack a NOC from their father. The Gujarat High Court recently issued an order in this regard. The passport office had refused to renew the documents without a NOC, prompting the minors’ divorced mother to approach the High Court.

According to a Times of India report, the Vadodara woman’s elder daughter was scheduled to appear for a test in the United States on November 8th. This test is crucial for further education. On August 12th, the Regional Passport Office official stated that the father’s consent is required for minors’ passport renewals.

The woman informed the court that she was divorced in March 2022 and that the children would live with her under an MoU. She also informed that her estranged husband had promised to assist with the legal formalities related to the children. It is reported that obtaining a NOC from her husband to renew the children’s passports is currently impossible, and that the daughter could be at a disadvantage if the passports are not granted.

The central government also did not object to the petition. During the hearing, Justice LS Pirzada cited Section 4(3) of Schedule 2 of the Passport Rules, 1980. He stated that if the parents are separated but have not formally divorced, the consent of one parent is required.

He stated that in this case, a divorce decree has been issued, and the children are in the mother’s custody under the MoU. The High Court stated, “Respondent No. 1 (RPO) is directed to consider the application dated July 11, 2025, filed by Petitioner No. 3 as the single parent, and to renew the passports of both minor petitioners as soon as possible, preferably within a week of the issuance of this order.”
