The Supreme Court on Monday directed 36,000 unaided private schools in Rajasthan to charge 15 per cent less annual fees for the students for the academic session 2020-21. In this decision, it has been clarified that no student will be prevented from joining the class if the fees are not paid or if the situation is normal, the result should not be stopped.
High court order upheld
The Supreme Court upheld the order of the Rajasthan High Court which rejected the challenge given to the validity of the rule made under the Rajasthan School (Regulation of Fees) Act 2016 and the law relating to fixation of fees in schools. .
‘Payment of fees in 6 equal installments’
A bench of justices AM Khanwilkar and Dinesh Maheshwari, in their 128-page judgment, made it clear that the fees will be paid by the students or parents in six equal installments for the academic session 2020-21. The bench said that it cannot be denied that an unprecedented situation has arisen due to the complete lockdown implemented due to the epidemic. This has had a serious impact on the people, the industry and the entire country.
‘Schools can give more discounts if they want’
Justice Khanwilkar mentioned in the judgment that in such economic crisis a large number of people lost their jobs. The judgment said, ‘The appellants (schools) should charge their students fees for the academic session 2019-20 under the arrangement prescribed under the 2016 law, but pay attention to the facilities not used by the students for the academic session 202021. In keeping with the fees, 15 percent less should be taken. If schools want to give more discounts to their students, they can give it.
