Trump Tariffs: Trump is unwilling to bow before the Supreme Court, imposing a new 10% tariff on all imports.

Trump Tariffs: Trump signed an executive order late Friday night. Under this order, new tariffs will be imposed starting Tuesday under Section 122 of the Trade Act of 1974. Trump stated that nothing has changed in the trade deal with India following the US Supreme Court’s decision.

The US Supreme Court has overturned the tariff hikes imposed by President Donald Trump against several countries. The decision was delivered by a 6-3 majority. Chief Justice John Roberts stated in the ruling that the tariffs Trump imposed on countries around the world were illegal and that the US President abused his authority by imposing large levies. Trump has described the court’s order as disappointing, but he is unwilling to relent. Following the Supreme Court’s decision, he has decided to increase tariffs on imports into the US by 10% on top of the current applicable rate. Trump has also ordered new investigations under other laws so he can reimpose the tariffs.

Trump signed an executive order late Friday night. Under this order, new tariffs will be imposed starting Tuesday under Section 122 of the Trade Act of 1974. This will partially replace the 10% to 50% tariffs imposed under the International Emergency Economic Powers Act of 1977. The International Emergency Economic Powers Act of 1977 has been declared invalid by the US Supreme Court.

Section 122 of the Trade Act of 1974 authorizes the US President to impose import surcharges of up to 15 percent, import quotas, or a combination of both to address “large and serious” balance-of-payments deficits.

Will tariffs on India be reduced?

Regarding tariffs and the trade deal with India, Trump stated that nothing has changed in the trade deal with India after the US Supreme Court’s decision. “They (India) will pay tariffs, and we won’t pay tariffs. So the deal with India is that they pay tariffs. It’s not the same as before,” Trump said, adding, “The India deal is done…all deals are done, we’re just going to do it differently.”

Under the interim trade agreement to be signed between India and the US, the US will reduce the reciprocal tariff on Indian goods to 18 percent. India is committed to significant tariff reductions and regulatory easing for US exports. Furthermore, the US removed an additional 25 percent tariff imposed on Indian goods for oil purchases from Russia, effective February 7, 2026.

The US had imposed an additional 25 percent tariff on imports of Indian goods in August 2025 as a penalty for oil purchases from Russia. After this, the tariff rate on goods going from India to America increased to 50 percent including the reciprocal tariff of 25 percent.
