US issued new advisory for Indian student-workers, visas will be canceled and they will be sent back!

US Embassy Warning: Every day some warning is being issued by the US Embassy in India. Most of these warnings are about overstay in the US i.e. staying longer than the time given on the visa. Every year millions of Indian students and workers go to the US for studies and jobs. In such a situation, they should be well aware of the warnings issued by the embassy. The reason for this is that if the rules are not followed, they can also be deported.

Meanwhile, once again the US Embassy has issued a warning regarding Indians, in which they have been warned about staying in the US for more than the prescribed period. The embassy has explained the difference between Admit Until Date i.e. ‘last date of entry’ and Visa Expiry Date i.e. ‘visa expiry date’. Explaining the difference between the two in a post on the social media platform X, it has been said that not only will the visa of the overstaying people be canceled, but they can also be deported.

What did the US Embassy say?

In a post on X, the US Embassy said, “The approved period of stay in your country is the ‘Last Date of Entry’ on your Form I-94, not your ‘Visa Expiration Date.'” The embassy further said, “Staying in the US longer than the approved period is called an overstay. This may result in cancellation of your visa, deportation, and ineligibility for future visas.”

What is the ‘last date of entry’?

The ‘last date of entry’ is given on Form I-94, which is an arrival/departure record issued by the US Customs and Border Protection (CBP). It tells in a way when the visa holder entered and left the US. The ‘visa expiration date’ tells when the visa given to the student or worker will expire. The expiration date of the visa i.e. when the visa will expire is written on it, but the details of the ‘last date of entry’ are not on the visa.

B-1/B-2 visitor visas, F-1 student visas or H-1B visas are fixed duration, that is, they have a fixed duration date mentioned on them. In such a case, to stay in the US legally after the date mentioned on such visas, they either have to get their visa extended or change their visa status.

Difference between visa expiry and ‘last date of entry’

The expiry date of the visa mentioned on the passport only determines the last date till which a person can use the visa to enter the US. It does not control how long a person can stay in the country after entering the US. Because of this, if a person stays in the US even after the ‘last date of entry’ mentioned on the I-94, then he is considered out of visa, even if his visa has not expired. The visa allows entry into the country, but the I-94 tells how long one can legally stay.
