Legal action can be taken if bounced

According to Advocate Chetan Pareek, if the check bounces, then the front party can file a lawsuit against you. In such a case, according to section 138, a complaint can be filed against you in court. If the person is found guilty in this case, then there is a provision for double the amount of check amount or 2 years punishment. However, a legal notice has to be given within 30 days of the check being bounced to make a complaint.




Chetan said, ‘In such a situation, after getting notice, the accused is given 15 days time to return the money. However, if the money is not paid for the check, then the complaint has to be submitted to the court within 30 days from the 16th day. In such a situation, try to give the check only if there is a provision for your money, otherwise the check bounced can make it difficult for you.

Action can be taken even if wrong check is filled

If you have given a check to someone, in which the name is written by someone else and the sign is made by someone else, then in such a situation action can be taken. Chetan said, “ Also, after giving the check, you can be processed if you make a stop payment. According to section 420, 467,468, an FIR can also be filed on you. Therefore, it is necessary to take care of many things before giving any check.
