The government has come up with a new policy for foreign workers, which has made it easier to change jobs. This policy was introduced during the Covid pandemic and now the government has decided to continue it. Under the policy, the company or job can be changed before obtaining a new work permit.
In fact, foreign workers working in Canada get an employer-specific work permit, which is also called a closed work permit. In simple words, through the work permit they get, they can work only for the company written on the permit. The foreign worker is allowed to do only the job given on this permit. If he wants to work in a new position or wants to change the company, then he has to get a new work permit for this.
Start work after taking permission from IRCC
According to the CIC News report, under the new policy, a worker working on a closed work permit can start working in a new company or new position even before getting a new work permit. For this, he just has to take permission from ‘Immigration, Refugees and Citizenship Canada’ (IRCC). The new policy has been implemented and it has replaced the old policy. A major change in this policy is that now there will be no need to give biometrics during the new work permit application.
On what conditions will one get the benefit of work permit exemption?
Now the question arises here that if someone has to work in a new company and has to start the job before getting a work permit, then how can he do this. What conditions will he have to fulfill. If a foreign worker fulfills the following conditions, then he can take advantage of the work permit exemption.
- The applicant lives in Canada on a valid temporary resident status.
- The applicant has submitted an application for a work permit.
- The applicant is authorized to work in Canada at the time of submitting the application.
- The applicant wishes to work for the job and company mentioned on the job offer.
The applicant will also have to apply for exemption under this policy on the IRCC website. They will also have to request that they be allowed to work until a decision is taken on their new work permit. IRCC tells within 10 to 15 days whether you will get work permit exemption under the new policy or not. If you get the green signal from IRCC, then you can start working without getting a new work permit.
